Caregiving involves real risks: driving clients, handling medications, lifting, and working inside someone's home. Here's how liability is handled under our service agreement, and why hiring an uninsured caregiver is a gamble you don't want to take.

Workplace and vehicle coverage

All Community Plus Care Ltd. employees are covered by workplace insurance through WorkSafe BC. That protects both our staff and our clients if a workplace injury happens during a shift.

When a care plan calls for transportation, our employees may drive clients in their own vehicles. Every employee who transports clients must hold a valid driver's license and carry vehicle insurance that covers business use. Community Plus Care Ltd. assumes no responsibility for incidents during transportation unless they result from an employee's proven negligence.

Insurance reimbursement and payment

If any services are submitted to an insurer for reimbursement, the Payor agrees to cover anything the insurer doesn't pay. We don't confirm insurance payments or track policy limits on your behalf. Any uncovered services remain the Payor's responsibility. We can help you determine a support plan that would fit the limits.

Indemnity and limits of liability

The Payor agrees to indemnify and hold Community Plus Care Ltd. harmless from all claims, demands, losses, or liabilities arising from services under this agreement, except where they result solely from our proven negligence or intentional misconduct. This clause is intended to be as broad as the law allows and survives termination of the agreement.

The indemnity covers claims tied to acts, errors, or omissions by our employees or agents acting within their duties. Community Plus Care Ltd. is not liable for indirect, incidental, or consequential damages, including lost profits or business, regardless of foreseeability. If indemnification is required, the Payor covers our reasonable legal fees and costs on a solicitor-client basis. Total liability is capped at the amount the Payor paid in the previous twelve months, except in cases of gross negligence or willful misconduct.

Pro-tip: Using an uninsured care provider or contractor comes with high liability if an injury occurs. If a private caregiver gets hurt in your home and has no WorkSafe BC coverage, you could be on the hook.
